Summary
|
|
On October 1, 1992, the undersigned was appointed Inquiry Officer and received a delegation of the power and duty to conduct inquiries and make orders under the Freedom of Information and Protection of Privacy Act (the Act) and the Municipal Freedom of Information and Protection of Privacy Act.
BACKGROUND:
The Ministry of Community and Social Services (the Ministry) received a request under the Act for access to records relating to an allegation of harassment. The requester subsequently clarified that she was requesting access to any notes, memos or reports which interpret her complaints and any summaries of her descriptions of the actions on which her complaints were based.
The Ministry identified three records as responsive to her request. The Ministry notified three individuals named in the records of the request, and asked them for their views regarding disclosure of the records. The three individuals did not consent to disclosure, and the Ministry informed the requester that access to the records was denied under section 49(b) of the Act, because disclosure would constitute an unjustified invasion of another individual's personal privacy.
The requester appealed the Ministry's decision. A mediated settlement was not possible, and notice that an inquiry was being conducted to review the Ministry's decision was sent to the Ministry, the appellant and the three individuals notified of the request by the Ministry. Written representations were received from the Ministry, the appellant and two of the individuals named in the records.
