Summary
The appellant made a request under the Municipal Freedom of Informationand Protection of Privacy Act (the Act ) to the City of Toronto (theCity). The request was for access to the most recent or final version of a realestate appraisal report prepared for the City by an independent appraiser in1995. The appraisal report relates to the potential market value ofapproximately 14 acres of land on the west end of the Greenwood Raceway propertywhich the City purchased from a named corporation. The City denied access to the report based on the following discretionaryexemptions: economic and other interests - sections 11(c), (d) and (e) The appellant appealed the City's decision to deny access. Thirty-four daysafter the date this office sent a confirmation of the appeal to the City, theCity notified the appellant that it was also relying on the followingdiscretionary exemptions: valuable government information - section 11(a) proposed plans, policies or projects of an institution - section 11(g) The appellant appealed the City's decision to deny access to the report. A Notice of Inquiry was sent to the City and the appellant. Subsequently, theCity notified this office that it believes the mandatory exemptions found insections 10(1)(a) and (c) of the Act apply to the record. Asupplemental Notice of Inquiry was sent to the City, the appellant and theindependent appraiser. Representations were received from the City and theappellant. The City did not submit representations with respect to theapplication of section 10 of the Act .
