Summary  The appellant is a columnist for a newspaper in the Town of Flamborough (theTown). In his column, he has written regularly on the issue of tax arrears andthe Town's treatment of property tax delinquents. On September 6, 1996, a "sham" newspaper, the FlamboroughExpositor, was circulated through the mail to 400 Town businesses accusing theappellant of being in a conflict of interest given that he owed substantialarrears on his own property. The article contained numerous other commentsabout the appellant. The article was written anonymously and contained a copyof the tax certificate on the appellant's property setting out the arrears.
