Summary
The Regional Municipality of Ottawa-Carleton (the Municipality) received a request under the Municipal Freedom of Information and Protection of Privacy Act (the Act ) for access to all records for the year 1992 relating to the water account respecting a property owned by the requester. The requester also specifically requested a copy of a facsimile sent by a named former tenant of the property (the affected person) to the Municipality concerning the water account. The Municipality provided the requester with partial access to the 17 page record responsive to the request. Access was granted in full to 10 pages, in part to six pages and denied in full to the one-page facsimile. For those parts of the record to which access was denied, the Municipality claimed exemption under section 14(1) of the Act . The requester appealed this decision. During mediation, the scope of the appeal was narrowed to the one-page facsimile. Further mediation was unsuccessful, and notice that an inquiry was being conducted to review the Municipality's decision was sent to the appellant, the Municipality and the affected person. Written representations were received from the Municipality and the affected person. The appellant indicated that his letter of appeal would form his representations in this matter.
