File a privacy complaint under Ontario’s provincial and municipal privacy laws

Information message

As of July 1, 2025, the IPC has new review powers under the Freedom of Information and Protection of Privacy Act or FIPPA that include making orders regarding institutions’ information practices. In addition, Institutions must notify the IPC of a breach if it is reasonable in the circumstances to believe that there is a real risk of significant harm to an individual, or in other prescribed circumstances. Such breaches must be reported to the IPC as soon as feasible after the head determines that the theft, loss or unauthorized use or disclosure has occurred.

In these circumstances, the FIPPA Institution is also required to notify the individuals affected by the breach. Please note that if the Institution did not notify you that your personal information was involved in a privacy breach, and your complaint relates to an Institution under FIPPA, it may not be possible  to process your complaint. You will be advised in writing if the IPC decides not to process your complaint.

Equivalent amendments to the Municipal Freedom of Information and Protection of Privacy Act or MFIPPA were not introduced. It is important to note that, with limited exceptions, and in contrast to FIPPA, the IPC does not have the power to make an order against a municipal institution as a result of a privacy breach.

Given the IPC’s restricted mandate and powers for privacy matters under MFIPPA, the IPC may decide not to process your privacy complaint. You will be advised in writing if the IPC decides not to process your complaint.

Under FIPPA and MFIPPA, the IPC cannot issue fines or award damages.
